The so-called "autopen" is a device that can replicate signatures, commonly used for mass signing of administrative documents. Previously, Trump and his supporters claimed that due to Biden's advanced age, his policy actions might lack full awareness, even suggesting that the use of autopen to sign documents could invalidate his decisions. However, there is no clear evidence to support these claims.

It is not yet clear whether Biden used such a device when signing the relevant pardon documents.

Emphasis on Two Types of Pardons

Martin pointed out in his email that the investigation will focus on two aspects:

  1. Preventive Pardons for Biden's Family: Details remain undisclosed as to whether this involves family members who have not yet been prosecuted or investigated.
  2. Collective Pardons for Death Row Inmates: Before leaving office, Biden issued an order granting clemency to 37 federal death row inmates, commuting their sentences to life imprisonment.

While such collective pardons are based on presidential privilege, conducting them during politically sensitive times is particularly prone to being seen as controversial "moral pardons."

Origination of Order Unknown, Department Stays Low-Profile

In the email, Martin did not disclose which higher institution or official issued the directive to start the investigation. Currently, the Department of Justice has not released a formal statement on the matter, nor has Biden's side made a public response.

However, observers note that if this investigation progresses, it could once again put Biden's end-of-term decisions under the spotlight and exacerbate the judicial conflict between the two parties over presidential power.

Political Motives Spark Controversy

This investigation has sparked strong discontent within the Democratic Party. Some commentators believe it resembles a "settlement" with clear political overtones, particularly as election year approaches. This may not only affect public perception of presidential pardon power but also trigger a broader constitutional discussion.

Although the president has broad pardon powers, their exercise and the choice of beneficiaries remain a sensitive area between law and politics. Whether the Justice Department during Trump's term will cross the line and use this for political pressure warrants ongoing observation.
